Terms of Service

These Terms explain the rules for using Chronoly, including account responsibilities, marketplace listings, dealer verification, communications and transactions between users.

Introduction

Welcome to Chronoly. These Terms of Service govern your access to and use of the Chronoly website, marketplace, messaging tools, seller profiles, verification services and other related features.

By creating an account, publishing a listing or otherwise using Chronoly, you confirm that you have read and agree to these Terms.

Where you use Chronoly on behalf of a business, you confirm that you have authority to bind that business to these Terms.

About Chronoly

Chronoly is an online marketplace designed to help buyers, private sellers and professional dealers discover and discuss watches.

Chronoly does not automatically inspect, possess, value, service or authenticate items listed by users. A verification badge relates to checks completed on an account or submitted information; it is not a guarantee that every item offered by that user is authentic, accurately described or suitable for purchase.

Eligibility

  • You must be at least 18 years old and legally capable of entering into contracts.
  • You must provide accurate, current and complete information.
  • You must not use Chronoly where doing so would breach a law, court order, sanction or contractual restriction applicable to you.
  • Chronoly may request evidence of identity, age, address, ownership or business status.

User accounts

You are responsible for maintaining the confidentiality and security of your login details and for activity conducted through your account.

You must notify Chronoly promptly if you believe your account has been accessed without permission. You must not sell, transfer, share or allow another person to misuse your account.

You may only create accounts for genuine use. Duplicate, deceptive, impersonating or fraudulently created accounts may be restricted or removed.

Buying watches

Buyers are responsible for carrying out appropriate checks before agreeing to purchase an item.

  • Review the listing, photographs, condition information and seller profile carefully.
  • Ask for recent timestamped photographs, serial or reference details, service history and proof of ownership where appropriate.
  • Independently consider authentication or inspection, particularly for high-value items.
  • Use secure, traceable payment and insured delivery methods.
  • Do not proceed where the seller, payment request or price appears suspicious.

A buyer must not make false claims, misuse payment disputes, attempt fraudulent chargebacks or deliberately retain an item without paying the agreed amount.

Selling watches

Sellers must have the legal right to offer every item they list and must provide information that is accurate, complete and not misleading.

  • Use photographs that genuinely show the item being offered.
  • Accurately describe the brand, model, condition, components, modifications, defects, service history and included accessories.
  • Clearly disclose aftermarket, replacement or non-original parts.
  • Keep availability, price and location information current.
  • Mark or remove a listing promptly when the item is no longer available.

Sellers must not manipulate photographs or omit material information in a way that could mislead a buyer.

Dealer accounts

Professional sellers must accurately identify themselves as businesses and comply with laws and consumer obligations that apply to their sales.

Chronoly may offer dealer memberships, analytics, promotional tools, enhanced profiles or other paid and unpaid features. Separate commercial terms may apply to those services.

Dealer status or approval may be suspended or withdrawn if supplied information becomes inaccurate, a dealer ceases trading, complaints raise material concerns or these Terms are breached.

Verification and trust badges

Chronoly may ask users to provide identity documents, proof of address, business records, contact information or evidence relating to ownership of an item.

Verification indicates only that specified checks were completed using the information available at that time. It does not amount to an endorsement, warranty, authentication of every listing or guarantee of future behaviour.

Users must not copy, alter, falsely claim or misuse a Chronoly verification or dealer badge.

Prohibited activity and content

  • Counterfeit, replica or stolen items.
  • Listings for items the seller does not own or have authority to sell.
  • Fraudulent documentation, fake proof of ownership or manipulated evidence.
  • Misleading descriptions, hidden defects or deceptive photographs.
  • Harassment, threats, hate, unlawful discrimination or abusive communications.
  • Malware, scraping intended to disrupt the service, automated spam or attempts to bypass security controls.
  • Attempts to impersonate Chronoly, another user, a dealer or a brand.
  • Activity involving money laundering, sanctions evasion, fraud or other unlawful conduct.

Payments and transactions

Unless a Chronoly service expressly states otherwise, Chronoly does not process, receive, safeguard or release the purchase price for transactions arranged between users.

Buyers and sellers are responsible for agreeing the price, payment method, delivery, inspection, return arrangements and any other transaction terms.

Chronoly does not recommend sending cash, cryptocurrency, gift cards or unprotected bank transfers to unknown persons. Users should independently check the protection offered by their chosen payment provider.

Fees, promotions and boosted listings

Chronoly may offer free listings, promotional periods, subscription services, sponsored placement or boosted listings. The price, duration, eligibility and features of any paid service will be shown before purchase.

Paid placement affects visibility only. It does not mean that Chronoly has authenticated, inspected or endorsed an item or seller.

Chronoly may change future prices or promotional offers, but this will not retrospectively alter a paid service already purchased unless required for legal, security or operational reasons.

User content and intellectual property

Users retain ownership of photographs, descriptions, videos and other original content they upload.

By uploading content, you grant Chronoly a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, display and distribute that content as reasonably required to operate, secure, promote and improve the marketplace.

You must have permission to upload the content you submit. Chronoly may remove material that infringes intellectual property, privacy or other legal rights.

Reports, moderation and disputes

Users may report suspicious listings, misconduct or abusive content. Reports must be made honestly and must not be used to harass competitors or other users.

Chronoly may investigate reports, request supporting information, restrict content, preserve records or contact relevant parties. Chronoly is not required to resolve private contractual disputes between users.

Where appropriate, users should also contact their payment provider, insurer, delivery company, trading standards, Action Fraud or the police.

Platform availability

Chronoly aims to provide a reliable service but does not guarantee that every feature will always be uninterrupted, secure or error-free.

Access may be temporarily limited for maintenance, updates, security work, service-provider failures or circumstances outside Chronoly's reasonable control.

Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded under applicable consumer law.

Subject to those rights, Chronoly is not responsible for the accuracy of user listings, authenticity or condition of watches, user conduct, external payment arrangements, delivery failures or losses caused by transactions between users.

Chronoly is not liable for indirect or consequential losses, loss of profit, loss of business opportunity or loss arising from reliance on information supplied by another user, except where such liability cannot legally be limited.

Suspension and termination

Chronoly may warn, restrict, suspend or terminate accounts, remove listings or limit functionality where reasonably necessary to protect users, investigate misconduct, comply with law or enforce these Terms.

Serious fraud, counterfeit activity, threats, repeated violations, security attacks or attempts to evade a previous suspension may result in immediate permanent removal.

Where appropriate and lawful, Chronoly may retain records required for fraud prevention, legal compliance, dispute handling and platform security after an account is closed.

Consumer rights

Nothing in these Terms removes rights that a consumer has under applicable law.

Legal rights may differ depending on whether a watch is sold by a private individual or by a professional dealer. Dealers are responsible for providing consumers with legally required information and honouring applicable cancellation, refund and product rights.

Chronoly's role as a marketplace does not replace the legal obligations owed by a professional seller to a consumer.

Changes to these Terms

Chronoly may update these Terms to reflect changes in the service, business model, security requirements or applicable law.

Material changes will be communicated through the platform, by email or by another reasonable method. Continued use after updated Terms take effect constitutes acceptance where permitted by law.

Governing law

These Terms are governed by the laws of England and Wales, subject to any mandatory rights you may have under the law of the country where you live.

The courts of England and Wales will have jurisdiction, except where applicable consumer law allows proceedings to be brought in another court.
